Anonymity and Confidentiality
Surrogacy
Solutions, LLC is a third party reproduction agency providing the
service of creating relationships between people who would not otherwise
find one another. Through Surrogacy Solutions, LLC, people who desire
to become parents of children and cannot do so alone, and women
who wish to assist those intended parents as a surrogate mother
or egg donor (or both), are able to meet and contract for the purpose
of creating a child for the intended parents using assisted reproduction
technology.
Surrogacy Solutions,
LLC is an Arkansas limited liability company formed by attorney
Monica Mason with its principal place of business at 7901 Hwy. 107,
Sherwood, Arkansas.
Arkansas law
is among the most favorable in the nation for surrogate parenting.
Working with Surrogacy Solutions will permit intended parents across
the country and abroad to take advantage of the favorable treatment
of surrogacy in Arkansas.
Our
Method
Surrogacy Solutions matches candidates for egg donation and surrogacy
with intended parents with painstaking and personal attention to
the needs and desires of both parties. Through our network and other
methods of location and selection of candidates we offer security
and peace of mind. As the relationship progresses, Surrogacy Solutions
facilitates the creation of a contractual relationship between the
parties, and handles all monetary negotiations with surrogates and
egg donors. The agency administers the surrogacy and egg donation
contracts, including coordination of medical services, throughout
the assisted reproduction technology process. By working with us,
intended parents, surrogates, and egg donors receive personalized
assistance with every aspect of the process. We are available to
all parties twenty-four hours a day, and even make travel and accommodations
arrangements for all parties. The agency guides all parties through
the process, taking care of the dozens of details and ensuring that
the relationship between the parties is an emotionally pleasant
experience focused exclusively on the joy of creating a family for
the intended parents, and resolving financial stress and other worries
for the intended parents.
The agency
is open 9 a.m. - 5 p.m. Monday through Friday, excluding national
holidays, but parties to contracts have 24-hour access to appropriate
personnel to assist with any immediate medical, psychological, or
administrative needs in connection with the contract.
Timetable
for Candidates for Surrogacy
- Complete profile.
- Within three months, we will begin additional screening procedures,
or notice will be given if Surrogacy Solutions is unable to approve
you as a candidate for surrogacy.
- Within three months to six months of the date you submit your
completed profile and complete the additional screening procedures,
you may expect us to submit your profile for review by intended
parents.
- Upon being matched with intended parents, you will undergo any
additional testing requested by the physician who will perform
the IVF or artificial insemination. This should be completed within
a month or so for traditional surrogacy and within three months
for gestational surrogacy.
- In traditional surrogacy, inseminations may begin with the
next cycle after final clearance by the physician. We recommend
in traditional surrogacy, up to three cycles of physician insemination
be undertaken with no more than three additional cycles as an
option; or, no more than two cycles of self-insemination (where
allowed by law) with up to four more inseminations by a physician.
In gestational surrogacy, six to ten weeks may pass between final
medical clearance and the actual IVF procedure because of the
time involved in coordinating the cycles of both women and the
physician. We recommend in gestational surrogacy, one IVF cycle,
with the option of up to two additional embryo transfers from
frozen or fresh embryos, if necessary.
Timetable
for Egg Donor
- Complete profile.
- Within three months, we will begin additional screening procedures,
or notice will be given if Surrogacy Solutions is unable to approve
you as an egg donor.
- Within four months to six months of the date you submit your
completed profile and complete the additional screening procedures,
you may expect us to submit your profile for review by intended
parents.
- You will be notified each time your profile is sent to intended
parents for consideration.
- Upon being matched with intended parents, you will undergo
any additional medical screening ordered by the treating physician,
which should take four to six weeks.
- Egg retrieval should occur within six to eight weeks after
final medical clearance by the treating physician. The egg donor
should have a follow-up exam to ensure her well being about one
week later.
Disclaimer
Surrogacy Solutions, LLC does not provide legal services or legal
advice to any person. Surrogacy Solutions will retain the services
of Monica L. Mason, P. A., an Arkansas law firm, to represent all
intended parents who work with the agency. The law firm will draft
the contract after negotiations for contract provisions and terms
are completed by the agency, will finalize the relationship between
the intended parents and their child after the birth of the child,
and will be available to the intended parents to answer any legal
questions throughout the process. The cost of these legal services
is paid on behalf of the intended parents by the agency directly
to the law firm, from the total fee paid to Surrogacy Solutions
by the intended parents.
Neither Surrogacy
Solutions nor the law firm will provide legal advice or legal services
to any surrogate or egg donor candidate. All egg donors and surrogates
must retain an attorney to review the final contract with them and
provide them with legal advice prior to signing the contract. Surrogacy
Solutions will assist any surrogate or egg donor candidate in locating
an attorney to represent them.
Surrogacy Solutions
does not provide medical advice to any person. Surrogacy Solutions
personnel will assist the parties by discussing medical advice provided
by the treating physicians in order to maximize the likelihood of
successful outcome from assisted reproduction technology.
Surrogacy Solutions
requires a psychological evaluation of surrogate and egg donor candidates
by a licensed psychologist within twenty-four months prior to entering
into a contract for surrogacy or egg donation. Some treating physicians
may require a more current evaluation. Surrogacy Solutions relies
upon the recommendation of the psychologist and does not undertake
to independently determine the psychological fitness of a surrogate
or egg donor candidate. Surrogacy Solutions does not typically require
a psychological evaluation of intended parents except where the
intended parents are related to their egg donor or surrogate; where
the intended parents and the surrogate or egg donor have known one
another on a personal basis; or where the intended parents and the
surrogate or egg donor are acquainted or otherwise have the likelihood
of coming into social contact with one another after the birth (i.e.,
members of the same church, friends, co-workers, relatives of in-laws,
etc.). Some treating physicians require psychological evaluations
of intended parents, regardless of the circumstances.
Surrogacy Solutions
does not guarantee that a surrogate or egg donor will pass final
medical testing or meet the requirements of a particular treating
physician. Surrogate and egg donor candidates accepted by the agency
and offered to intended parents will meet the statistical requirements
of at least some treating physicians as to age, weight, and height.
Statistical data on a selected surrogate or egg donor candidate
should be submitted to the actual treating physician for pre-approval.
The ultimate decision to proceed with any surrogate or egg donor
candidate belongs exclusively to the intended parents, and should
be made in consultation with the treating physician.
Surrogacy Solutions
does not guarantee that any particular surrogacy or egg donation
will result in a pregnancy, or that any pregnancy created will result
in a live birth.
Anonymity
and Confidentiality
We recommend
that giving and receiving donor eggs be made on an informed but
anonymous basis. Intended parents will be provided with the egg
donor's profile with all identifying information except the donor's
first name and city of residence redacted. Egg donors will be provided
with the first names, state of residence, and brief explanation
about the reason donor eggs are required for the intended parents.
Additional non-identifying information about the donor requested
by the intended parents will be obtained and provided. Donors may
request additional non-identifying information about the intended
parents, such as occupation or city of residence, and that information
will be provided only with the consent of the intended parents.
In gestational
and traditional surrogacy arrangements, we discourage anonymity.
However, we encourage a particular level of confidentiality. Neither
party will be provided with the other party's social security or
driver's license numbers under any circumstances. For the home address
of a party to be disclosed to the other party, both parties must
agree to the disclosure. The state of residence, age, marital status,
and explanation of the reason surrogacy is required for the intended
parents will be provided to the surrogate candidate. The surrogate
may request additional non-identifying information about the intended
parents, such as occupation or city of residence, and that information
will be provided if known, unless the intended parents specifically
instruct us to the contrary.
All surrogacy
and egg donation files are confidential, and that confidentiality
extends to the law firm of Monica L. Mason, P.A. Agency personnel
will not discuss or disclose information contained in our files,
except to medical providers where necessary to treatment.
Our file regarding
a specific intended parent will be available for reference
by that intended parent for a limited time in the future, upon
providing us with adequate assurance of identity and a written
request
for
information
signed
under oath. We do not undertake permanent storage of any files.
Availability of files in the future does not extend to the children
created from a surrogacy or egg donation, or to surrogates and
egg donors
unless otherwise provided in the contract.
Absent an order
of a court of competent jurisdiction, we will not disclose the identity
of an anonymous egg donor to any person under any circumstances
at any time. Absent an order of a court of competent jurisdiction,
we will neither confirm nor deny the fact of surrogacy or egg donation
as to as to any person; provide the identity of a surrogate or egg
donor; provide the identity of any intended parent; or disclosure
the identity of a child created from surrogacy or egg donation to
any person at any time for any reason, absent the consent to disclosure
of all original parties made in writing and signed under oath. Any
surrogate or egg donor may provide to us at any time written consent
to disclose information in the event such information should be
requested in the future.
Excluding the
identity of a surrogate or egg donor, we will honor a future request
for disclosure of information contained in an intended parent's
file to their child of another person only under the following circumstances:
- Order of
any court of competent jurisdiction compelling our disclosure
of information
- Power of
attorney from either intended parent to another person given while
of sound mind, and which specifically authorizes that person to
obtain any information contained in the Surrogacy Solutions files
pertaining to their child by surrogacy or egg donation accompanied
by medical or legal evidence of signature verification and competence
at the time of execution, together with medical or legal evidence
of incapacity or incompetence at the time of request (i.e., you
give a power of attorney in the event of your incapacity, and
you then lapse into a coma), all of which must be satisfactory
to Surrogacy Solutions
- Specific
grant in an intended parent's last will and testament to a named
and identified person of the right to obtain any information contained
in the Surrogacy Solutions files pertaining to their child by
surrogacy or egg donation, accompanied by a court order admitting
the will to probate after your death, and a written request by
the person signed under oath accompanied by assurance of identity.
It is important that intended parents plan ahead in this regard
because neither their death without instructions in their will
nor appointment by a court of a legal guardian of their person
or estate will be sufficient evidence of intent that we disclose
information and such requests will not be honored.
We will make
a reasonable effort to assist you in locating your traditional surrogate
or egg donor during your child's lifetime in the event of demonstrated
medical need. However, we will not disclose an address or telephone
number of your traditional surrogate or egg donor to you after the
birth of your child, despite medical need, without the prior consent
of the surrogate or egg donor. |
